The owner/publisher of Tenancy Support Services Ltd who reserves the right to refuse any review or advertising, or to cancel any existing review or advertisement on the grounds of objectionable content, or any misuse of the service provided.

We reserve the right to permanently remove users and prevent access for violations of our Terms and Conditions.

Use of Site

Tenancy Support Services Ltd authorises you to view/download/print a single copy of the chosen site content for your own personal use only.

You may not copy, reproduce, transmit or distribute in any way tenancysupport.co.nz content, software or code.

This site must not be used for illegal, misleading (section 12 of the Fair Trading Act 1986), deceptive, or prohibited purposes.

Accessing the review database for any activity other than for the purpose of seeking information for personal use is strictly prohibited.

The content of the Site, its design, text, graphics, illustrations and images are unless otherwise stated copyright of STARS. Unauthorised use is strictly prohibited. All title to, ownership of and intellectual property rights in the Site are owned by Tenancy Support Services Ltd  No licence is granted or rights given in any way to users of the Site.

Reproduction

The content of the Site may not be copied, reproduced or distributed in any form, in whole or in part, without written permission from Tenancy Support Services Ltd . Note that Listing Agents may use the Tenancy Support Services Ltd  ratings on their websites pursuant to information elsewhere notified.

Accuracy of information and limitation of liability

Tenancy Support Services Ltd  has taken reasonable care that the content of this website, including the information and property information, is correct on the basis of the most current information available to it. Tenancy Support Services Ltd  publishes such information in good faith. As user you acknowledge and accept that: Tenancy Support Services Ltd  cannot and has not checked the accuracy of information provided by accommodation providers such as landlords and letting agents ('Landlords'); this information may include errors; and while Tenancts and Landlords are requested and encouraged to provide correct information, and correct and update their information regularly and as needed,

Tenancy Support Services Ltd  will not be responsible for errors, omissions or misleading information in property information and ratings. To the maximum extent permitted by law, Tenancy Support Services Ltd will not be liable to you under any circumstances for any loss or damage arising from the use of, or reliance on the Site or the information it contains. Tenancy Support Services Ltd  reserves the right to amend the ratings and information on properties, based on information received, which are audited, feedback received through the Site, and/or any relevant information.

Exclusion of Liability

In no event shall Tenancy Support Services Ltd  nor its employees be liable for any damage whatsoever including direct, indirect, consequential, financial loss or special damages by you or any third party, even if Tenancy Support Services Ltd  or its employees or suppliers have been advised of the possibility of such damages. Tenancy Support Services Ltd  shall have no liability for any personal injury to or death of you or any third party unless caused directly by a negligent act or omission on the part of Tenancy Support Services Ltd .

Vary information

Tenancy Support Services Ltd reserves the right to vary and amend the contents of the Site (or any part of it) at its discretion and without notice and excludes any resulting liability.

Law of New Zealand

These terms and conditions shall be construed and applied in accordance with the laws of New Zealand, and you consent to the exclusive jurisdiction of the New Zealand Courts to determine any matter or dispute which arises under these terms and conditions in accordance with the laws of New Zealand. 

Legal compliance

Members and Advertisers must acknowledge and accept that they are bound to comply with the following New Zealand statutes:

Privacy Act 1993 (NZ), Bill of Rights 1990 (NZ), Human Rights Act 1993 (NZ)

Together with all equal opportunity and anti-discrimination laws applicable in the country in which their business operates.

Tenancy advertisements posted by advertisers and members on the Tenancy Support Services Ltd & tenancysupport.co.nz   site must at all times comply with applicable professional codes of conduct and legislation included in but not limited to the Commerce Act 1986 (NZ) and the Fair Trading Act 1986 (NZ).

Information management and security

You the user acknowledge and accept that you are responsible for the security of your own password and login details for access to this site. If your access login and password are used by others, you acknowledge that in signing up for membership, that you, and any/all seperate IP's tracked logging into our site, using your details may be temporarily or permanently blocked. The enforcement of this, is at the sole discretion of Tenancy Support Services Limited.

If you believe your login account has been compromised, you accept a responsibility to contact us and inform us of the breach of security, which at our discretion, may or may not negate the fee for any IP's tracked logging in, as mentioned in the above paragraph directly above this one.

We,Tenancy Support Services Ltd will continually attempt to ensure the privacy and security of your information. Our registration and payment transmissions are transmitted by a secure encrypted system for your safety. However, there may be a possibility that the information could be illegally viewed during transmission over the Internet. We disclaim all liability in the extraordinary event of this occurring and assure users that such violations will be actively pursued with the assistance and co-operation of the relevant enforcement authorities.

Liability

As Tenancy Support Services Ltd acts only as a facilitator bringing together tenants and landlords, we have no control over the quality of material posted. We have no involvement in the truth, accuracy or otherwise of the materials (including reviews) and advertisements posted.

We therefore accept no liability for any risks that users may encounter through the use of our website/s .

You, the user, accept all risks and furthermore accept that you are solely responsible for the content, form and accuracy of any details, material and advertisements you post on this site.

The services of tenancysupport.co.nz are provided without any warranties express or implied.

We make no warranty relating to accuracy, reliability, access or content. All reasonable attempts will be made to ensure that any disruptions to service, access denial or similar availability problems for users will be attended to and remedied as soon as practicably possible.

You will acknowledge and accept that we do not guarantee that files available for download from a third party via and/or through our site will be virus free.

You accept that it is your responsibility to ensure that you are equipped with electronic security systems for your own protection.

Statutory guarantees provided for under the Consumer Guarantees Act 1993 shall not apply as any tenancy advertisement posted is for the purposes of the advertisers business.

Any changes in company control or ownership as relates to advertisers and employers bound by the terms and conditions of this site agreement will require written approval from Tenancy Support Services Ltd assigning said rights and obligations to the new entity.

Payment Terms

Advertisers and employers must at all times be paid financial members of Tenancy Support Services Ltd to have authorised ongoing access to all tenancysupport.co.nz services. A one-off payment for a set period of months must be paid in advance to ensure continuity of service. Appropriate and timely reminders will be communicated to all advertisers and employers as their renewal date approaches. Failure to make payment by the due date may result in a temporary suspension of service. Non-payment after 30 days may result in termination of the service. Failure to make full payment within 30 days will void the moneyback guarantee offer unless other terms relating to payment have been approved by us in writing and have been met.

Tenancy Support Services Ltd  wholly owns copyright of the material and trademarks that directly relate to any content on this site.

For the purposes of this agreement: ‘site’, ‘us’, ‘we’, refer to Tenancy Support Services Ltd.
